1. Broker Status & Parties
1.1 Company Identification
American Auto Link, LLC ("Company," "we," "us," or "our") is a federally licensed property broker registered with the United States Department of Transportation (USDOT #4182533) and the Federal Motor Carrier Safety Administration (FMCSA). Our broker authority MC #1610585 is on file with the FMCSA and may be verified at
safer.fmcsa.dot.gov.
1.2 Broker — Not a Carrier
THE COMPANY IS A TRANSPORTATION BROKER ONLY. We do not own, operate, or employ trucks, trailers, drivers, or any vehicle transport equipment. We do not physically transport vehicles. Our sole function is to act as an intermediary agent between you ("Customer") and independent, federally licensed motor carriers ("Carrier") who perform the actual transportation of your vehicle.
1.3 No Employment or Agency Relationship with Carriers
Carriers contracted through our network are independent businesses and are not employees, agents, partners, or joint venturers of the Company. The Company has no right to control the means, methods, or manner of any Carrier's transportation services.
By placing an order, you acknowledge: (a) the Company is not a motor carrier; (b) the Company does not assume carrier liability for your vehicle; (c) your vehicle will be transported by a third-party Carrier; and (d) any claims for loss or damage must be pursued against the responsible Carrier and/or its insurer.
2. Quotes & Pricing
2.1 Nature of Quotes
All quotes — whether online, by phone, or by email — are estimates based on information you provide and current market conditions. Quotes are not guaranteed prices until you have confirmed an order and paid your deposit.
2.2 Quote Validity
Quotes are valid for seven (7) calendar days from issuance unless otherwise stated in writing. After seven days, market conditions may have changed and a new quote may be required.
2.3 Price Changes After Booking
Your confirmed booking price is locked at the time you place your order and pay your deposit. The Company will not increase a confirmed price unless: (a) your vehicle information is materially inaccurate; (b) your pickup or delivery location changes; (c) your requested dates change materially; or (d) you request additional services not in the original order.
2.4 Carrier Rate Adjustments
If available carriers will only transport your vehicle at a price above the quoted rate — due to low availability, unusual vehicle types, or peak season — the Company will notify you and present the revised rate. You may accept or decline. If you decline, your deposit will be refunded in accordance with Section 5.
2.5 Factors Affecting Price
Final pricing may be affected by fuel surcharges, seasonal demand, route availability, vehicle dimensions and weight, transport type (open vs. enclosed), pickup/delivery locations (terminal vs. door-to-door), and other market factors. You represent that all vehicle information you provide is accurate.
2.6 Oversized & Modified Vehicles
Vehicles exceeding standard dimensions (generally over 18 ft long, 7 ft tall, or 5,000 lbs GVW) or those with modifications affecting dimensions or ground clearance may be subject to additional fees. You are responsible for accurately disclosing all modifications at booking.
3. Payment Terms
3.1 Deposit
A deposit is due at the time of booking and covers the Company's brokerage fee for locating, vetting, and dispatching a Carrier. The deposit is charged to your card when your order is confirmed.
3.2 Balance Due at Delivery (COD)
The remaining balance is due and payable directly to the Carrier at delivery, unless otherwise agreed in writing. Payment is typically required in cash (U.S. dollars) or certified funds. Confirm accepted payment methods with the Carrier at dispatch.
3.3 Authorization to Charge
By providing payment information, you authorize the Company to charge the deposit (and any applicable processing fees) to the payment method on file. You represent that you are authorized to use the payment method provided.
3.4 Disputed Charges
If you initiate a chargeback without first contacting the Company in good faith to resolve the dispute, we reserve the right to pursue recovery of all amounts owed, including costs of collection, to the extent permitted by applicable law.
4. Scheduling, Pickup & Delivery Dates
ALL PICKUP AND DELIVERY DATES AND WINDOWS ARE ESTIMATES ONLY AND ARE NOT GUARANTEED. The auto transport industry operates on dynamic carrier scheduling, and dates are subject to change due to carrier availability, weather, road conditions, mechanical issues, regulations, and other factors beyond the Company's control.
4.1 First Available Date
Your "first available date" is the earliest date your vehicle will be ready for pickup. Actual pickup may occur on that date or within a window of several days thereafter, depending on carrier availability on your route.
4.2 No Guaranteed Times
The Company cannot guarantee specific pickup or delivery times within a given day. Carriers will typically contact you 12–24 hours before arrival to confirm timing.
4.3 Customer Availability
You or an authorized representative must be present at both pickup and delivery to inspect the vehicle and sign the Bill of Lading. If no authorized person is available and the Carrier has made reasonable attempts to complete service, you may be responsible for additional fees.
5. Cancellation & Refund Policy
5.1 Pre-Dispatch Cancellation
If you cancel before a Carrier has been dispatched and assigned to your order, you may be entitled to a partial refund of your deposit, less an administrative cancellation fee to cover the Company's costs. Submit all cancellation requests in writing to
support@americanautolink.com.
5.2 Post-Dispatch Cancellation — No Refund
Once a Carrier has been dispatched and accepted your shipment, your deposit is NON-REFUNDABLE, even if the Carrier has not yet arrived at your pickup location. The Company's brokerage services have been substantially performed at the point of dispatch.
5.3 Post-Pickup Cancellation
Cancellations are not permitted after the Carrier has taken physical possession of your vehicle. Any arrangements for release must be negotiated directly with the Carrier and may be subject to additional fees.
5.4 Carrier-Initiated Cancellation
If a dispatched Carrier cancels before pickup, the Company will make commercially reasonable efforts to locate a substitute Carrier at no additional charge. If we cannot secure a suitable substitute within a reasonable time at the agreed price, you will receive a full refund of your deposit.
5.5 Cancellation Procedure
All cancellation requests must be submitted in writing to
support@americanautolink.com or through your customer portal. The effective date of cancellation is the date the Company receives your written notice. Approved refunds are processed within 5–10 business days to the original payment method.
6. Vehicle Preparation Requirements
6.1 Operability
Unless you have specifically booked inoperable vehicle transport, your vehicle must be in operable condition at pickup — meaning it can be driven on and off a transport trailer under its own power with functioning brakes and steering. If your vehicle becomes inoperable after booking and you have not disclosed this, the Carrier may refuse pickup or assess an additional inoperable vehicle fee.
6.2 Remove All Personal Items
Remove all personal belongings, valuables, and non-factory items before pickup. Neither the Company nor Carriers are responsible for personal items left in the vehicle. Federal regulations generally prohibit the transport of personal property in vehicles being shipped.
6.3 Fuel Level
Reduce your fuel tank to approximately one-quarter (1/4) tank or less. Excess fuel adds unnecessary weight to the transport load.
6.4 Alarms & Transponders
Disable all vehicle alarm systems and provide the Carrier with disarming instructions and spare keys. Remove all electronic toll transponders (E-ZPass, SunPass, FasTrak, TxTag, etc.) to prevent inadvertent toll charges during transport. Toll charges incurred due to failure to remove transponders are your sole responsibility.
6.5 General Condition
Ensure the battery is adequately charged, tires are inflated, and there are no fluid leaks. Retract or secure all antennas. Remove or secure any loose parts, running boards, bike racks, spoilers, or exterior accessories that could become dislodged during transport.
6.6 Ground Clearance
Standard open-carrier transport requires a minimum of approximately 4–5 inches of ground clearance. Lowered or modified vehicles may require enclosed transport or flatbed service at additional cost. You are responsible for disclosing your vehicle's ground clearance at booking.
Strongly recommended: Take dated photographs of your vehicle from all angles immediately before pickup. These photos may be essential to document pre-transport condition if a damage claim becomes necessary.
7. Insurance, Liability & Damage Claims
7.1 Carrier Insurance Requirements
The Company requires all Carriers in its network to maintain minimum cargo insurance of $100,000 per occurrence and commercial auto/liability insurance of no less than $750,000 per occurrence (consistent with FMCSA requirements). We verify Carrier insurance certificates prior to dispatch.
7.2 Carrier is Responsible for In-Transit Damage
Legal liability for damage occurring to your vehicle during transport rests exclusively with the Carrier, not the Company. The Company is a broker and does not insure your vehicle or assume carrier liability. Your sole recourse for transport-related damage is against the Carrier and/or the Carrier's insurance.
7.3 The Bill of Lading (BOL)
At pickup, the Carrier will inspect your vehicle and prepare a Bill of Lading documenting existing condition. YOU MUST review the BOL carefully and ensure all pre-existing damage is accurately noted BEFORE you sign. At delivery, inspect your vehicle and note any new damage on the delivery BOL BEFORE signing. Signing the delivery BOL without noting damage indicates receipt in the documented condition.
7.4 What Carrier Insurance Typically Does Not Cover
Standard carrier cargo policies generally do not cover: pre-existing damage; damage to custom or aftermarket parts; mechanical or electrical failures not caused by a transport incident; hail or weather damage on open transport; interior damage; items left inside the vehicle; or diminution in value. Consult your personal automobile insurer for supplemental coverage options.
7.5 Damage Claim Procedure
- Note all damage on the delivery BOL in writing before signing and before making any payment to the Carrier.
- Take time-stamped photographs of all damage immediately at delivery from multiple angles.
- Do not refuse delivery — accepting while noting damage preserves your rights.
- Contact the Company's support team within 24–48 hours of delivery at support@americanautolink.com.
- Submit a written damage claim directly to the Carrier and/or Carrier's insurer. The Company will provide carrier insurance information.
- Obtain at least two written repair estimates from licensed facilities.
7.6 Claim Submission Deadline
Written damage claims must be submitted to the Carrier within seven (7) days of delivery. Failure to notify the Carrier within this timeframe may significantly impair or eliminate your ability to recover damages.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE BROKERAGE SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT OF THE BROKERAGE DEPOSIT PAID BY YOU FOR THE SPECIFIC SHIPMENT. THE COMPANY IS NOT LIABLE FOR VEHICLE DAMAGE DURING TRANSPORT, PERSONAL PROPERTY LEFT IN THE VEHICLE, OR ANY INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
8. Pickup & Delivery Locations
8.1 Door-to-Door Service
The Company arranges door-to-door transport, meaning the Carrier will attempt to pick up and deliver your vehicle as close to your specified addresses as is legally and physically practical.
8.2 Access Limitations
Not all locations are accessible to large transport trucks (up to 75 feet in length). If direct access is blocked by low bridges, narrow streets, HOA rules, weight restrictions, or physical obstructions, the Carrier will arrange a nearby alternative meeting point. The Company is not responsible for additional time or inconvenience caused by inaccessible addresses.
9. Force Majeure
Neither the Company nor any Carrier shall be liable for delays or service interruptions caused by events beyond their reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, civil unrest, government actions, public health emergencies, pandemics, labor strikes, fuel shortages, road closures, infrastructure failures, or any other event that could not reasonably have been anticipated or prevented.
In the event of a Force Majeure Event, delivery schedules will be adjusted accordingly. Force Majeure Events do not entitle you to cancel your order without forfeiting your deposit unless the delay exceeds 30 calendar days from the originally estimated pickup date.
10. Representations & Warranties
10.1 Customer Representations
By placing an order, you represent and warrant that: (a) you are the legal owner of the vehicle or have written authorization from the owner to arrange its transport; (b) all vehicle information provided is accurate and complete; (c) all pickup and delivery addresses and dates are accurate; (d) you are at least 18 years of age; (e) if acting on behalf of a business entity, you have authority to bind that entity; and (f) the vehicle does not contain any contraband or hazardous materials.
10.2 Warranty Disclaimer
THE COMPANY MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SERVICES PROVIDED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. THE COMPANY DOES NOT WARRANT SPECIFIC PICKUP OR DELIVERY DATES, UNINTERRUPTED SERVICE, OR ANY PARTICULAR TRANSIT TIME.
11. Indemnification
You agree to indemnify, defend, and hold harmless the Company and its members, managers, officers, employees, agents, and successors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your breach of any representation, warranty, or obligation under these Terms; (b) inaccurate information provided at booking; (c) failure to properly prepare your vehicle; (d) personal items left in your vehicle; (e) your vehicle leaking fluids or causing damage to other vehicles; or (f) your negligence or intentional misconduct in connection with pickup, delivery, or your interactions with Carriers.
12. Governing Law & Dispute Resolution
12.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Arkansas, without regard to conflict of law provisions, and applicable federal law including 49 U.S.C. § 14501 et seq.
12.2 Informal Resolution
Before filing any formal claim, the parties agree to first attempt to resolve any dispute informally by providing written notice describing the dispute in reasonable detail and negotiating in good faith for 30 days.
12.3 Binding Arbitration
Except for claims qualifying for small claims court, any dispute arising out of or relating to these Terms or the services provided shall be determined by binding arbitration before a single arbitrator, administered by the American Arbitration Association in accordance with its Consumer Arbitration Rules. Judgment on the award may be entered in any court having jurisdiction.
12.4 Class Action Waiver
YOU AND THE COMPANY AGREE THAT EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
12.5 Limitation on Actions
Any legal action against the Company arising out of these Terms must be commenced within one (1) year after the cause of action accrues. After this period, any such claim is permanently barred.
13. Electronic Communications & Consent
13.1 Electronic Consent
By providing your email address and phone number, you consent to receive electronic communications from the Company, including order confirmations, shipment updates, and service notices.
13.2 SMS / Text Message Consent
By providing your mobile phone number, you expressly consent to receive text message (SMS) communications regarding your order, including dispatch notifications, driver contact information, and delivery updates. Message and data rates may apply. Reply STOP at any time to opt out.
13.3 Marketing Communications
If you have separately opted in to marketing communications, you may receive promotional emails or texts. You may opt out at any time by following the unsubscribe instructions in any marketing email or by contacting us at
support@americanautolink.com.
14. Changes to These Terms
The Company reserves the right to modify these Terms at any time. Modified Terms will be posted on this page with an updated effective date. For existing orders placed before a modification, the Terms in effect at the time of order placement will govern. Continued use of our website or services after the effective date of any modification constitutes your acceptance of the updated Terms for any new orders.
15. Miscellaneous
15.1 Entire Agreement
These Terms, together with any order confirmation issued by the Company, constitute the entire agreement between you and the Company regarding the brokerage services and supersede all prior agreements or representations, whether written or oral.
15.2 Severability
If any provision of these Terms is held invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary and the remaining provisions shall continue in full force and effect.
15.3 No Waiver
The Company's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
15.4 Assignment
You may not assign your rights or obligations under these Terms without our prior written consent. The Company may assign its rights freely, including in connection with a merger, acquisition, or sale of assets.
